Legal privilege arises from communications between a client and their legal adviser. Where privilege matters, we recommend that clients instruct external counsel and that NARADism be engaged through counsel, working as counsel's agent under counsel's direction. Where a company instructs us directly, we say so plainly: the work is not privileged, and we recommend that counsel be appointed where exposure is material.
